The Services are operated by Perry J, LLC, doing business as Astreaux (“Astreaux,” “we,” “us,” or “our”). By accessing or using our Services, you agree to be bound by these Terms. 2. Services Description
Astreaux is an AI sales assistant that automates responses to advertisement forms and sets up sales appointments via SMS, Facebook, Instagram, and WhatsApp. The Services are designed to enhance your sales processes by providing efficient and automated communication.
3. Eligibility
By using our Services, you represent and warrant that you are at least 18 years old, you have the legal capacity to enter into these Terms, and you will use the Services only for lawful purposes and in accordance with these Terms.
4. Account Registration
To use certain features, you may need to create an account. You agree to provide accurate, current, and complete information during registration, maintain the security of your password and account, notify us immediately of any unauthorized use, and be responsible for all activities under your account.
5. Prohibited Uses
You agree not to use the Services for unlawful purposes, to impersonate others, to interfere with or disrupt the Services, or to violate any applicable laws.
Prohibited Content: Sending prohibited messages is a serious violation, including SHAFT violations (Sex, Hate, Alcohol, Firearms, Tobacco), illegal substances, high-risk financial services, third-party lead generation without consent, and spam or phishing.
Businesses that repeatedly violate A2P regulations may face escalating penalties, including suspension of SMS capabilities and fines.
6. Intellectual Property
All content, features, and functionality on the Services, including text, graphics, logos, and software, are the exclusive property of Astreaux and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.

By using the Services, you consent to our data practices as described in the Privacy Policy.
8. Payment and Billing
If you purchase services, you agree to pay all associated fees. Payments are non-refundable except as described in our Refund Policy. We reserve the right to change fees with 30 days’ notice. Customers on yearly contracts are not subject to price changes until renewal.
Refund Policy: Unless otherwise stated, all payments are final. Refunds are granted only where required by law or expressly offered in writing by Astreaux.
9. Termination
We may suspend or terminate your access immediately, without notice, if you breach these Terms. Upon termination, your right to use the Services will cease immediately.
10. Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant uninterrupted, error-free, or virus-free operation.
11. Limitation of Liability
Astreaux and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or goodwill, arising from your use of the Services.
12. Indemnification
You agree to indemnify and hold harmless Astreaux (Perry J, LLC), its affiliates, officers, employees, and agents from any claims or damages arising out of your use of the Services or your violation of these Terms.
13. SMS Terms and Carrier Requirements
Astreaux AI provides automated SMS communications related to sales engagement and appointment scheduling.

Carriers are not liable for delayed or undelivered messages.

14. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law rules. You agree to the exclusive jurisdiction of state and federal courts in California.
15. Changes to Terms
We may modify these Terms at any time. If changes are material, we will give at least 30 days’ notice via email and/or a notice posted in the Service. By continuing to use the Services after revisions, you agree to the updated Terms.
16. AI Usage and Responsibility
Astreaux uses AI models to assist with sales messaging and lead engagement. Users are responsible for reviewing and approving AI-generated messages before sending. You agree not to use the Services for misleading or harmful content and remain responsible for compliance with communication laws (TCPA, CAN-SPAM, GDPR, etc.).
17. User Content and Data Ownership
You retain all rights to the content, prompts, and data you provide. By using Astreaux, you grant us a limited license to host and process content solely to operate and improve the Services. We do not sell or share your content without consent, except as required by law or to provide core functionality.
18. Third-Party Services
Our Services may integrate with third-party platforms (e.g., Meta, HubSpot, Twilio). We are not responsible for disruptions or data loss caused by these third parties. Your use of their platforms is governed by their terms, including:
